Judge Gregory Carro dismissed two murder charges related to acts of terrorism on Tuesday (September 16).
The reason is because he said the evidence presented to the grand jury wasn’t strong enough to support a terrorism charge.
“While the defendant was clearly expressing an animus toward UHC, and the health care industry generally, it does not follow that his goal was to ‘intimidate and coerce a civilian population,’ and indeed, there was no evidence presented of such a goal,” the judge said in his decision, provided by ABC News.
The rest of the indictment stays as is.
“We respect the Court’s decision and will proceed on the remaining nine counts, including Murder in the Second Degree,” the Manhattan District Attorney’s Office said in a statement, per ABC News.
Luigi faces a charge of second-degree murder, “two counts of criminal possession of a weapon in the second degree, four counts of criminal possession of a weapon in the third degree, one count of criminal possession of a weapon in the fourth degree and one count of criminal possession of a forged instrument in the second degree.”
He previously pled not guilty to state charges in New York and Pennsylvania as well as the federal charges.
NBC News reports that if he “is found guilty of the highest count in the New York state charges, he could face 25 years to life in prison.”
